Re: Trail Closures In Norfolk County

I could not find the petition in there. It is horrible about what the nature conservancy of Canada is doing down in Norfolk county. They truly are the evil empire. I have spoken with several folks down there and people have been totally blindsided.

    Fact :
Closing of a common road is illegal.

The Road Access Act states :

When common road may be closed
    (2) No person shall construct, place or maintain a barrier or other obstacle over a common road that as a result prevents the use of the road unless,
    (a) the person has made application to a judge for an order closing the road and has given ninety days notice of the application to the parties and in the manner directed by this Act and the judge has granted the application to close the road: or
    (b) the closure is of a temporary nature for the purposes of repair or maintenance of the road.
    IDEM
    (4) Notice of an application to close a common road shall be published at least once a week for four successive weeks in a newspaper that is circulated in the area in which the proposed road closure is located, the last publication to be not less than ninety days before the date fixed for the hearing of the application, and any person who uses the road is entitled to be a party to the proceedings on the application.

The Road Access Act can be found here :

THE OFTR NEEDS TO GET BACK ON THIS ISSUE and show OUR NUMBERS. I tried once with Ken and made some headway(even though the process was rigged against us). Dave G needs to take this up again. Neil, do you know if Dave G is getting these pleas for help??? Can you forward to him asap?

Dave is in Florida this week, first for NOVHCC conference and now for personal vacation time, he'll be back Monday, i'm confident he will pick this back up upon his return. In the meantime, if you have thoughts on how the OFTR can contribute or help drive this, love to get some input from people that are in that area!

Most local councils in southern Ontario aren't interested in hearing from "our numbers". They might listen to local ORM enthusiasts, but they are not selling ORM tourism like Haliburton County is, and they just tend to get their backs up when confronted with outsiders looking for a place to ride. I would love to be wrong on this, and if someone can show me that council would like to hear from outsiders, I am willing to write or even attend meetings. Please keep up the good fight and keep us informed.
Thanks for all the effort spent to date.
